1. Introduction

These Terms of Service ("Terms") govern your use of NerdSystem, operated by HikerNerd LLC. By creating an account or making a purchase, you agree to these Terms. If you do not agree, please do not use our services.

2. Accounts

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account. You may not share your account or login credentials with others. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

• Redistribute, resell, or share course content with anyone who has not purchased access.
• Use automated tools to scrape, download, or copy course materials in bulk.
• Attempt to gain unauthorized access to other users' accounts or our systems.
• Use the service for any unlawful purpose.

4. Intellectual Property

All course content, including text, video, code examples, and graphics, is owned by HikerNerd LLC and protected by copyright law. Your purchase grants you a personal, non-transferable, non-exclusive license to access and use the course content for your own learning. You may use code examples from the course in your own projects but may not republish course materials as educational content.

5. Payments

NerdSystem offers one-time purchases with lifetime access. All payments are processed securely through Stripe. Prices are listed in USD and may be subject to applicable taxes. By making a purchase, you authorize us to charge the payment method you provide.

6. Refunds

Refund requests are handled according to our Refund Policy. Please review it before making a purchase.

7. Limitation of Liability

To the maximum extent permitted by law, HikerNerd LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of NerdSystem. Our total liability shall not exceed the amount you paid for the service. The course and deploy service are provided "as is" without warranties of any kind, express or implied.

8. Service Availability

We strive to keep NerdSystem available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. Lifetime access refers to the lifetime of the product.

9. Termination

We may terminate or suspend your access if you violate these Terms. You may close your account at any time by contacting us. Upon termination for violation, you forfeit access to purchased content without a refund.

10. Governing Law

These Terms are governed by the laws of the state in which HikerNerd LLC is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting updated Terms on this page and updating the "Last updated" date. Continued use of NerdSystem after changes constitutes acceptance of the revised Terms.

12. Third-Party Infrastructure Costs

NerdSystem's deploy feature automates the provisioning of infrastructure on third-party cloud providers such as DigitalOcean. You acknowledge and agree that:

• NerdSystem does not host, manage, or bill for cloud provider infrastructure. All compute, database, bandwidth, and other resource costs are billed directly by the cloud provider to your account.
• You are responsible for monitoring your cloud provider account for usage and charges.
• You are responsible for managing resource scaling and destroying infrastructure when it is no longer needed to stop incurring charges.
• HikerNerd LLC is not liable for any unexpected, excessive, or disputed charges from your cloud provider.
